Section 1 – Scope and General Information
These General Terms and Conditions (GTC) apply to all orders placed by you as a consumer (§ 13 BGB – German Civil Code) via our online shop. Deviating conditions of the customer shall not be recognized unless we have expressly agreed to them in writing.
Our website is operated on the Shopify platform. The purchase contract, however, is concluded exclusively between you and LELA Sleep GbR.
Important note: In the event of discrepancies between this English translation and the original German version of the GTC, the German version shall prevail.
Section 2 – Access and Account
To use our services and place orders, you must be at least 18 years old. You are required to provide complete and correct information (name, address, e-mail, payment details). You are responsible for the security of your customer account (if applicable) and login data. Transferring your account or login data to third parties is not permitted.
Section 3 – Our Products
We strive to display our products as accurately as possible. Color variations or deviations in appearance may occur due to different devices, monitor settings, or lighting conditions and do not constitute a defect. We reserve the right to change products, remove them from our range, or limit quantities at any time.
Section 4 – Conclusion of Contract
The product presentation in the online shop constitutes a legally binding offer. By clicking the button “Buy now”, you submit a binding purchase offer. The purchase contract is concluded when we confirm your order by e-mail. If products are unavailable, we will inform you without delay.
Section 5 – Prices, Taxes, and Invoicing
All prices are stated in euros and include statutory VAT. Additional shipping costs may apply, which are clearly displayed during the order process. Price changes are reserved. For contracts already concluded, the prices indicated at the time of purchase apply. Invoices are sent electronically by e-mail.
Section 6 – Payment
We offer various payment methods shown during the checkout process, including: Credit card (Visa, Mastercard, American Express), PayPal, Klarna (invoice purchase, instant transfer, installment payment), Apple Pay / Google Pay, SEPA direct debit, Shop Pay (Shopify’s accelerated checkout solution).
If you select invoice purchase or installment payment, the additional GTC of the respective payment provider (e.g. Klarna) apply. A credit check may be carried out.
Section 7 – Delivery and Shipping
Deliveries are made to the delivery address specified by the customer. Delivery times are indicated on the product pages. Delays caused by force majeure, strikes, official measures, or supply shortages entitle us to a reasonable extension of the delivery period. Upon handover of the goods to the shipping provider, the risk of accidental loss passes to the customer (§ 446 BGB).
Section 8 – Retention of Title
The goods remain our property until full payment has been made (§ 449 BGB).
Section 9 – Right of Withdrawal and Return Policy
You have the right to withdraw from this contract within 14 days without giving any reason. The period begins on the day you receive the goods. To exercise your right of withdrawal, you must send us a clear statement (e.g. via e-mail) to LELA Sleep GbR, Blumenstraße 31, 74357 Bönnigheim, info@lelasleep.de.
We will refund all payments, including standard shipping costs, within 14 days after receiving the returned goods. Refunds are made using the same payment method used in the original transaction. You bear the direct costs of returning the goods.
Important limitation for bedding (hygiene articles): According to § 312g para. 2 no. 3 BGB, the right of withdrawal is excluded for goods that are not suitable for return for health or hygiene reasons, if their seal has been removed after delivery. This means: duvets, pillows, and covers may only be returned if unopened, unused, and sealed. Once the hygiene/seal protection is broken, returns are excluded.
Section 10 – Warranty
The statutory warranty rights apply (§§ 434 ff. BGB). In the event of defects, you are entitled to subsequent performance (repair or replacement). If subsequent performance is impossible or unsuccessful, you may withdraw from the contract or reduce the purchase price. Further claims remain unaffected.
Section 11 – Transport Damages
Please check the goods immediately upon receipt. Obvious transport damage must be reported immediately to the carrier and to us without delay.
Section 12 – Intellectual Property
All content on this website (texts, images, logos, designs) is protected by copyright. Any use without our express written consent is prohibited.
Section 13 – Prohibited Uses
You may not misuse our website or services, in particular not for unlawful purposes, infringement of copyright, trademark, or personal rights, distribution of viruses, spam, or malware, or bypassing technical security measures.
Section 14 – Data Protection
The collection and processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR). Responsible party: LELA Sleep GbR, Blumenstraße 31, 74357 Bönnigheim. Data is used exclusively for contract processing (shipping, payment, customer service). Data will only be passed on to necessary service providers (e.g. payment providers, logistics). Details can be found in our Privacy Policy.
Section 15 – Liability
We are only liable for slight negligence in the event of a breach of essential contractual obligations. Our liability is limited to the foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.
Section 16 – Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
Section 17 – Severability Clause
Should individual provisions of these GTC be invalid, the remainder of the contract shall remain valid.
Section 18 – Amendments to the GTC
We reserve the right to amend these GTC at any time. The current version will be published on our website. For contracts already concluded, the version valid at the time of contract conclusion applies.
Section 19 – Applicable Law and Jurisdiction
German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes shall be, insofar as legally permissible, the registered office of LELA Sleep GbR.
